Terms of Service for Cadenza

Agreement and who we are

These Terms of Service (“Terms”) govern your use of Cadenza, available at cadenza.so. Cadenza is operated by Medhansh Malhotra, an individual based in New Delhi, India (“Cadenza,” “we,” “us,” or “our”). By creating an account or using the service, you agree to these Terms. If you do not agree, please do not use the service.

The service

Cadenza is an AI-powered tool that generates branded Instagram content — carousel images, captions, and hashtags — based on the information you provide about your business. Cadenza is a paid subscription product: an active subscription is required to use it, and there is no free tier.

Your account

You must provide accurate information when you sign up and keep it up to date. You are responsible for keeping your login credentials secure and for everything that happens under your account. Accounts are for one person — do not share your account or let others sign in as you. Tell us promptly at support@cadenza.so if you think your account has been compromised.

Subscriptions and billing

Subscriptions are processed by Polar.sh, our merchant of record. Polar handles payment processing, invoicing, and tax; your payment is a transaction with Polar acting on our behalf.

You can subscribe monthly or annually. Subscriptions auto-renew at the end of each billing period until you cancel. You can cancel any time from the in-app billing page, which opens the billing portal; cancellation takes effect at the end of your current billing period, and you keep access until then. If we change our prices, we will give you reasonable advance notice, and any change applies to billing periods after the notice.

Acceptable use

When you use Cadenza, you agree not to:

• use it to create unlawful, infringing, hateful, or otherwise harmful content;
• abuse the AI generation — for example by automated scraping, overloading the service, or trying to bypass usage limits;
• resell or redistribute access to Cadenza;
• attempt to access other users' data or accounts, or probe, scan, or breach the security of the service.

Content and ownership

You own the content Cadenza generates for you, and you may use it commercially. You keep ownership of the inputs you provide (your business information, brand details, and any samples). You grant us the license we need to process those inputs — including sending them to the AI providers described in our Privacy Policy — solely to deliver the service to you. We may use anonymized, aggregated usage data to operate and improve Cadenza.

AI-generated content

Cadenza's content is generated by AI and may contain inaccuracies. You are responsible for reviewing everything before you publish it. We do not guarantee that generated content is accurate, original, or fit for any particular purpose, and you use it at your own risk.

Third-party platforms

Cadenza is not affiliated with, partnered with, or endorsed by Instagram, Meta, or any other platform where you publish. You are responsible for following the rules and terms of any platform you post to, and for making sure your content complies with them.

Termination

You can stop using Cadenza and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or use the service in a way that harms us or other users. When your account ends, we handle your data as described in our Privacy Policy.

Disclaimers and limitation of liability

Cadenza is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the service is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law.

Governing law and disputes

These Terms are governed by the laws of India. If a dispute arises, you agree to first contact us at support@cadenza.so and try in good faith to resolve it directly before taking any other action.

Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last Updated” date above, and for significant changes we will give you reasonable notice. Continuing to use Cadenza after a change means you accept the updated Terms.
